Feldman Shepherd secures victory for victims everywhere in the Supreme Court of Pennsylvania

Attorneys Mark W. Tanner and Peter M. Newman successfully prosecuted an appeal from a ruling in a Chester County trial court all the way to the Pennsylvania Supreme Court, persuading the Supreme Court to reverse the trial court’s ruling that had wrongly found a state statute unconstitutional.  The statute, known as the “Dragonetti Act”, provides remedies to victims of unscrupulous attorneys who file meritless lawsuits against them for improper purposes.  Tanner and Newman represent a woman who brought such a claim against an attorney, and the trial court dismissed the claim, finding the statute unconstitutional, reasoning it infringed on the exclusive authority of the Supreme Court to regulate the conduct of attorneys.  Tanner argued before the Supreme Court and got the Court to reverse this ruling and reinstate the claim,  arguing that the statute provided an important remedy to victims of attorney misconduct, and attorneys — like everyone else — should be held accountable for their misdeeds.
