In The Courts

Attorneys Alan M. Feldman, Daniel J. Mann and Edward S. Goldis represent the family of a mother and daughter who sustained fatal burn injuries when a 100 pound propane cylinder in their food truck suddenly exploded.  The lawsuit asserts that the U-Haul locations at which the cylinders were filled should have known, from the specialized training provided to U-Haul employees, that the cylinders were old, unsafe for use and legally prohibited from use.  It is expected that dozens of witnesses will provide deposition testimony about how and why this catastrophic incident occurred.  Trial of the case is expected to take place in early 2018.

Attorneys John M. Dodig and Jason A. Daria recovered $2M for a fire fighter who fell twenty-five to thirty feet through a skylight while combatting a four-alarm fire, sustaining serious and permanent injuries. Notwithstanding the $2 million settlement, the trial court found there was no insurance coverage for the award or for the defendant found responsible. On appeal to the Appellate Division the trial court ruling was reversed, insurance coverage was found to be applicable and the plaintiff was able to recover the full amount of the settlement.

Feature Update

Feldman Shepherd secures victory for victims everywhere in the Supreme Court of Pennsylvania

Attorneys Mark W. Tanner and Peter M. Newman successfully prosecuted an appeal from a ruling in a Chester County trial court all the way to the Pennsylvania Supreme Court, persuading the Supreme Court to reverse the trial court’s ruling that had wrongly found a state statute unconstitutional.  The statute, known as the “Dragonetti Act”, provides remedies to victims of unscrupulous attorneys who file meritless lawsuits against them for improper purposes.

Tanner and Newman represent a woman who brought such a claim against an attorney, and the trial court dismissed the claim, finding the statute unconstitutional, reasoning it infringed on the exclusive authority of the Supreme Court to regulate the conduct of attorneys.  Tanner argued before the Supreme Court and got the Court to reverse this ruling and reinstate the claim,  arguing that the statute provided an important remedy to victims of attorney misconduct, and attorneys — like everyone else — should be held accountable for their misdeeds.
