Attorneys Daniel S. Weinstock and Carolyn M. Chopko obtained a settlement* of $1.6 million on behalf of a child with cerebral palsy as a result of medical malpractice at a major Texas teaching hospital.

Like many other states, Texas has recently enacted tort reform laws designed to prevent medical malpractice victims from successfully bringing suit against doctors and hospitals. The hospital in which this child was born has been held to be immune from liability under one of the recent tort reform enactments. Feldman Shepherd attorneys Weinstock and Chopko were the first lawyers to successfully defeat this hospital’s motion for dismissal based on the tort reform law. This legal victory may pave the groundwork for other victims across Texas to success in their ability to bring such cases in the future.

While the legal issue was pending on appeal, the parties agreed to settle the case for $1.6 million. At the insistence of the defendants, the names of the parties are being held confidential.

*Attorneys Weinstock and Chopko handled this case on a pro hac vice basis, which is when lawyers not licensed in a particular state associate with a lawyer who is licensed in that state and obtain the court’s permission to jointly represent a client in a specific matter.
