$1.7 Million Settlement for Man Misdiagnosed with a Recurrence of Cancer

Attorneys Mark W. Tanner and Daniel Klaproth secured a settlement of $1.7 million for a man who was misdiagnosed as suffering from a recurrence of cancer, causing him to unnecessarily undergo chemotherapy when, in fact, his cancer had not returned. The client had previously undergone chemotherapy for Hodgkin’s Lymphoma which appeared to have been successful in overcoming the disease when a routine follow-up PET scan showed some increased activity. His provider diagnosed him with a recurrence without performing a confirmatory biopsy, and a rigorous course of chemotherapy was commenced. During the course of the client’s care, he sought a second opinion concerning some of his treatment, at which time another provider ordered a biopsy which confirmed that, in fact, the cancer had not returned. In the interim, the client suffered from a myriad of complications caused by the chemotherapy itself which was later proven to have been unnecessary.
