During the second week of trial, attorneys Daniel S. Weinstock and Carolyn M. Chopko settled a Missouri medical negligence case for $2.5 million*. The case was different from a classic birth injury case in that the allegations of negligence revolved around failures of the obstetrician to properly manage the mother’s diabetes during pregnancy. The defendants, on the other hand, very aggressively argued that the mother had failed to test her own glucose levels as directed during pregnancy, and that she stopped taking her insulin mid-way through the pregnancy. The hotly contested case was tried for a week and a half before the defendants finally relented and agreed to pay the sum of $2.5 million.

At the insistence of the defendants, the names of the parties are being held confidential.

*Attorneys Weinstock and Chopko handled this case on a pro hac vice basis, which is when lawyers not licensed in a particular state associate with a lawyer who is licensed in that state and obtain the court’s permission to jointly represent a client in a specific matter.
