$3.85 Million Settlement in Cerebral Palsy Case

Attorneys Daniel S. Weinstock and Carolyn Chopko secured a $3.85 million settlement during discovery on behalf of a child who during labor and delivery suffered brain damage leading to spastic quadriplegic cerebral palsy due to a delay in performing a cesarean section.

More than two hours elapsed from when nursing staff first noted late decelerations of the fetal heart rate and when the baby was delivered by cesarean section. During that time, fetal monitoring tracings continued to show that the fetal heart rate pattern required immediate delivery.

The settlement will provide for the child’s lifelong medical needs and developmental support.
