In August 2011, attorneys Daniel S. Weinstock and Carolyn M. Chopko settled* a medical negligence case for $4.25 million. The plaintiff in the case was a child who ended up with cerebral palsy as a result of a delay in delivery.

Attorneys Weinstock and Chopko argued the delay was caused by a combination of physician misinterpretation of fetal monitoring strips and poor communication between the physician and the hospital’s nursing staff. Following nearly an hour of delay, the child ended up with a severely bradycardic heart rate, leading to significant neurological injuries.

The settlement is projected to take care of the child’s lifelong special needs resulting from her brain injury. Defendants have insisted on confidentiality as a term of the settlement.

*Attorneys Weinstock and Chopko handled this case on a pro hac vice basis, which is when lawyers not licensed in a particular state associate with a lawyer who is licensed in that state and obtain the court’s permission to jointly represent a client in a specific matter.
