$7.5 million settlement of rural Michigan obstetric case involving brain injuries to the infant plaintiff during the course of labor and delivery. Reportedly the second highest med mal settlement in Michigan at the time.

Attorneys Carol Nelson Shepherd and Patricia M. Giordano represented a minor-plaintiff’s mother who arrived at the hospital in labor. Signs of a concealed placental abruption were ignored/mis-interpreted by the nurses who failed to report significant findings to the on-call obstetrician who was outside the hospital. As a consequence his arrival at the hospital was so delayed that severe hypoxic brain injury had occurred to the infant. Shepherd and Giordano developed important evidence through obtaining the “audit trail” established numerous changes had been made to the patient’s computerized hospital record well after the events occurred.
