In February, Feldman Shepherd held a “Maximizing Your Client’s Recovery in Personal Injury Cases from Investigation Through Trial” CLE in New Jersey.

Alan Feldman began the seminar by presenting on “Infant Carriers that Kill”, proving product defect pursuant to New Jersey Law, and overcoming legal obstacles and defenses. Alan spoke extensively about the unique issues he encountered while representing Anthoinette Medley, whose infant son was killed while being carried in an Infantino SlingRider. Daniel Mann then spoke on “How Discovery Techniques can be used to Maximize the Value of a Product Liability Case”. Dan discussed the value added to a case through testing, computer animations, high tech depositions, damages videos, and use of other similar techniques.

Patricia Giordano spoke about “Identifying the Deep Pocket Before Filing the Complaint”. Trish explained the importance and value of utilizing pre-complaint discovery and the specific nuances of New Jersey Court Rule 4:11, which governs depositions before action or pending appeal or for use in other jurisdictions.

Ezra Wohlegelernter addressed the importance of “Turning the Routine Case into Something Bigger”. Ezra discussed the helpful techniques to employ to increase value of a case: Use of demonstrative aids; surgical illustrations, pain and suffering charts, treating physician testimony; and social media traps to avoid decreasing the value of a case.

Daniel Weinstock tackled “Overcoming the New Jersey Charitable Immunity Limits in Medical Malpractice Cases”. Daniel addressed the issues raised when trying to collect verdicts and settlements from an entity with statutorily capped damages.

Jason Daria presented “Discovery Techniques to Increase Value in Construction, Trucking and New Jersey Tort Claims Act Litigation” where he explained the use of “super deposition” technology, contracts, and architectural drawings to find theories that will appeal to the jury.

John Dodig closed the CLE with “Arguing Non – Economic Damages before a Jury”. John lectured on specific techniques to increase jury verdicts for pain and suffering, embarrassment and humiliation, and loss of life’s pleasures.
