Nearly $1 Million Recovered for Death of 94-Year-Old in Motor Vehicle Accident

On March 29, 2019, LW was a passenger in a vehicle operated by his wife EW, on their way to a medical appointment for LW. As EW turned left from Belmont Avenue onto the Avenue of the Republic in the West Fairmount Park section of Philadelphia, her car was struck on the passenger side by a vehicle operated by JM. EW testified at her deposition that she did not recall seeing an approaching vehicle as she began making her left turn.

LW, a retired marine biologist who was 94 years of age, sustained chest, spleen and other blunt impact injuries. While he was conscious at the accident scene and upon arrival at Penn Presbyterian Medical Center, his condition deteriorated quickly. Three days after the accident, LW expired from his injuries.

LW was survived by his wife EW and three adult children. In a lawsuit filed by Feldman Shepherd lawyers Alan M. Feldman, Daniel J. Mann and Edward S. Goldis, LW’s Estate recovered the $500,000 policy limits of EW’s insurance liability policy, and another $495,000 from an excess underinsured motorist policy.
